1. Acceptance of Terms
These Terms of Service govern your access to and use of ApplyKPI and any related websites, applications, features, content, and services offered by ApplyKPI and TheCastleLabs ("ApplyKPI," "TheCastleLabs," "we," "our," or "us"). By accessing, browsing, registering for, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Your use of the Service constitutes ongoing acceptance of these Terms and any future updates we publish.
2. Description of Service
ApplyKPI is a job application tracking and job search analytics tool designed to help users organize applications, monitor search activity, and review performance-related information. The Service may include dashboards, application tracking, email-related features, reporting, metrics, and AI-assisted insights.
ApplyKPI does not provide recruiting services, staffing services, legal services, or guaranteed career outcomes. We do not promise interviews, offers, employment, compensation improvements, or any other result.
3. AI-Generated Content Disclaimer
Certain outputs, including "Actionable Insights," suggestions, summaries, recommendations, classifications, or other generated material, may be produced in whole or in part by automated systems or artificial intelligence. These outputs are provided for general informational purposes only.
AI-generated content may be incomplete, inaccurate, misleading, delayed, or inappropriate for your situation. It is not career advice, legal advice, financial advice, or professional advice of any kind. You are solely responsible for reviewing, validating, and deciding whether to rely on any AI-generated output. ApplyKPI and TheCastleLabs disclaim all liability for actions taken or not taken based on such content.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it current.
We may suspend, restrict, or terminate any account, access, or use of the Service at any time, with or without notice, for any reason or no reason, in our sole discretion. We are not liable for any loss arising from such suspension or termination.
5. Free vs Pro Plans
ApplyKPI may offer free and paid plans with different features, limits, usage allowances, or access levels. We may add, remove, modify, or restrict features, plan terms, limits, or pricing at any time.
Where reasonably practicable, we will provide notice of material pricing changes before they take effect for a current paid term. Nothing in these Terms guarantees that any particular feature, integration, plan, or pricing structure will remain available.
6. Payments and Refunds
If you purchase a paid plan, you agree to pay all fees, charges, taxes, and applicable billing amounts associated with your subscription or purchase. You authorize us and our payment processors to charge your selected payment method.
All sales are final. Payments are non-refundable except where refunds are required by applicable law. Partial-period refunds, credits, downgrades, unused time, and goodwill exceptions are not guaranteed.

8. Prohibited Use
You may not use the Service in any manner that is unlawful, abusive, harmful, or unauthorized. Prohibited conduct includes:
- Scraping, crawling, copying, harvesting, or extracting data from the Service without our prior written consent
- Reverse engineering, decompiling, disassembling, probing, or attempting to discover source code, models, or underlying systems except where prohibited by law from being restricted
- Interfering with, disrupting, overloading, or damaging the Service or its infrastructure
- Using the Service to transmit unlawful, infringing, deceptive, abusive, or harmful material
- Attempting to bypass account limits, access controls, rate limits, or security measures
- Using the Service in violation of any law, regulation, or third-party right
We may investigate suspected misuse and take any action we consider appropriate.
9. Limitation of Liability
To the maximum extent permitted by law, ApplyKPI, TheCastleLabs, and their affiliates, owners, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, opportunities, or expected savings, arising out of or related to the Service or these Terms.
To the maximum extent permitted by law, our total aggregate liability for any and all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid us for the Service during the three months immediately preceding the event giving rise to the claim, or (b) twenty-five U.S. dollars if you paid nothing during that period.
10. Indemnification
You agree to defend, indemnify, and hold harmless ApplyKPI, TheCastleLabs, and their affiliates, owners, officers, employees, contractors, licensors, and service providers from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your content or data, your violation of these Terms, your violation of law, or your violation of any third-party right.
11. Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration on an individual basis, except that either party may seek appropriate injunctive or equitable relief in a court of competent jurisdiction for misuse of intellectual property or unauthorized access.
You and ApplyKPI each waive any right to a jury trial and any right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding. You may bring claims only in your individual capacity.
12. Changes to Terms
We may modify these Terms at any time in our sole discretion. Updated Terms become effective when posted or when otherwise communicated by us, unless we specify a later effective date.
Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.
